ARTICLE 1 : GENERAL

These Terms and Conditions exclusively govern the sale of finished products, spare parts, and accessories offered online on the SBE France website. An order to purchase products on the http://www.mespiecesdetachees.com website constitutes the Buyer’s full and unreserved assent to these conditions. SBE France reserves the right to modify these conditions at any time. The Buyer is responsible for ensuring they have the latest Terms and Conditions when placing an order to purchase products. The http://www.mespiecesdetachees.com website is reserved for natural and legal persons established in metropolitan France (including Corsica) and Monaco.

ARTICLE 2 : PRODUCTS

Photographs showing products to support text descriptions are not bound by contract. SBE France shall not be held liable in the event of an error. The site describes the products’ essential characteristics. Buyers are invited to read the instructions for use and all other information attached to the product or on its packaging, including all conditions and precautions for use. For more information, Buyers can contact Customer Service on +33 (0)3 21 87 72 92 from Monday to Friday from 9:00 a.m. to 5:00 p.m. or via the form in the “Contact us” section of the site.

ARTICLE 3 : ORDERS

Buyers placing their first order must enter their email address, surname, first name, and a strictly personal password. The password is needed for every order. Buyers undertake to never communicate their password to a third party, otherwise they bear all the consequences if their password is used by a third party. To place an order, the Buyer must select product(s) by clicking on the "Add to cart" or "Buy this product" link, then click on "Pay order". A summary of the product(s) ordered will be displayed for the Buyer’s confirmation by clicking on the payment method Carte Bleue, MasterCard, Visa. The confirmed order is firm and final, and automatically saved. The Buyer will receive a confirmation email from SBE France. SBE France reserves the right to refuse all or part of an order placed by a Buyer who presents issues such as a previous payment incident or refusal of payment from banking centers. SBE France will inform the Buyer as soon as possible and by all means possible.

ARTICLE 4 : AVAILABILITY

Products and prices are valid when visible on the site, subject to availability.

ARTICLE 5 : PRICES

Prices displayed on the website http://www.mespiecesdetachees.com are indicated in Euros and include all taxes. The prices do not include shipping costs which are calculated according to the weight of the package. Shipping costs are shown in the order summary when online payment is requested. Products are billed according to the valid prices when the order was made, subject to availability. SBE France reserves the right to change prices and shipping costs at any time. Sales documents shipped with appliances sold online indicate the unit cost of the Eco-participation for waste disposal, to the best of SBE France’s knowledge.

ARTICLE 6 : PAYMENT

The payment of purchases for metropolitan France (including Corsica) and Monaco is made in Euros by bank card: Carte Bleue, Visa or MasterCard. Online payments benefit from the SSL (Secure Socket Layer) encryption method to ensure banking data remains confidential. During the transaction, the Buyer is automatically connected to the server of the payment processing center. All banking data is protected by encryption. No banking data passes through the SBE France system, and is therefore not retained by SBE France.

ARTICLE 7 : SHIPPING TIME

The Buyer is informed of shipping time, expressed in business days, when the order is approved internally. The shipping date takes into account preparation and dispatch, plus carrier delivery time. The average shipping time is 2 (two) to 7 (seven) working days from when your order is approved. Shipping may take longer if the product is not physically present in our centralised stock. If the shipping time exceeds the average delivery time shown above by 7 (seven) working days, the Buyer can request a refund by registered letter with acknowledgement of receipt, as provided for by law. In any event, the shipping time should not exceed 60 (sixty) days. Products are delivered to the delivery address provided by the Buyer when making their order.

ARTICLE 8 : SHIPPING

Products are shipped in mainland France (including Corsica) and Monaco to the delivery address indicated by the Buyer when making their order. The Buyer is responsible for checking the condition of the delivered goods in the presence of the carrier. In the event of damage or missing items, the Buyer must:

  • indicate clear, significant, precise, and complete reservations on the transport documents,
  • confirm these reservations to the carrier by registered letter with acknowledgement of receipt within 3 (three) days of receiving the goods.

Buyers who do not respect this clause will be held liable.

 

ARTICLE 9 : RIGHT TO CANCEL

In accordance with current regulations, individual Buyers have 14 (fourteen) days from receipt to return items at their own expense. This excludes items that can be copied such as software, CDs, and DVDs unless they are returned in their original sealed packaging (art L121-20-2 fourth). When an order is eligible for return, please contact SBE France for a return reference number by email on the “Contact us” page or by telephone on 33 (0)3 21 87 72 92. The Buyer must return products in their original packaging, in perfect condition, with all accessories and instructions. The return reference number must appear on the outer packaging of the returned product. Products returned incomplete, damaged, or used shall not be exchanged or refunded. Returns that do no comply with this procedure will be refused and cannot be refunded. Business customers: All spare part returns, whether defective, broken, or for any other reason, must be requested on the www.mespiecesdetachees.com website. The Buyer receives approval of their request depending on the type of part and the reason. Each part must be returned in its original packaging with the order label and the summary slip printed at the end of the return request. All incomplete requests will be refused. Please contact Customer Service for special cases: +33 (0)3 21 87 72 92. If this procedure is not followed, the parts will not be identified, and therefore not eligible for exchange or refund.

ARTICLE 10 : WARRANTY

Finished products sold on the site are covered by a one-month contractual warranty from the date on the invoice. The Buyer must contact Customer Service as soon as they observe an anomaly. A full description of the problem with the product is required. Some brands manage after-sales service directly with the Buyer, and provide a home pick-up service. In that case, SBE France’s Customer Service provides the Buyer with all the necessary contact information for addressing the request to the manufacturer. The warranty is limited to the repair, replacement, or reimbursement of the value of the goods observed to be defective by SBE France. The warranty does not apply to: (i) batteries, consumables, cables, and spare parts; (ii) damage or problems resulting from incorrect use, mistreatment, accident, alteration, or unsuitable electrical current or voltage; (iii) products with a damaged warranty seal or serial number. The warranty is null and void in the event of damage caused to the product as a result of natural disasters, fire, lightning, misuse, or use contrary to the precautions for use and instructions, unsuitable maintenance, negligence, incorrect handling or installation, unauthorized repair, modification or accident. All returns are subject to prior agreement by SBE France and are at the Buyer's expense. All returns must include a copy of the invoice, the delivery note, and a note detailing the reasons for the request, with the serial number for finished products. If the return request procedure is not fully respected, the product will not be accepted for repair and will be returned to the Buyer. Outside this contractual warranty, SBE France shall be held liable for any noncomformity and hidden defects of the goods according to Articles 1641 to 1649 of the French Civil Code. French Consumer Code Art. L 211-4 The Seller is required to deliver goods in compliance with the contract and is liable for any nonconformity at the time of delivery. They will also be liable for any nonconformities due to packaging, assembly instructions, or installation for which they are responsible according to the contract, or that have been carried out under their responsibility. French Consumer Code Art. L211-5 For contract compliance, goods must: (i) Be fit for the intended purpose and, where applicable: - Correspond to the description given by the Seller and feature the qualities the Seller presented to the Buyer in the form of a sample or model; - Feature the qualities a Buyer can legitimately expect in view of the public statements made by the Seller, the producer, or their representative, particularly in advertising or labelling; (ii) Feature the characteristics defined by mutual agreement by the parties or be suitable for any special use required by the Buyer that have been explained to and accepted by the Seller. French Consumer Code Art. L211-12 Action resulting from lack of conformity lapses two years after delivery of the product. French Civil Code Art. 1641 The Seller is bound to a warranty against hidden defects in the goods sold that render it unfit for its intended use, or that so impair its use that the Buyer would not have bought it, or would have paid a lower price had they known of the defects. French Civil Code Art. 1648 para. 1 An action arising from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.

ARTICLE 11 : JURISDICTION

Orders are governed by French law. Unless otherwise provided by mandatory law, disputes shall be subject to the exclusive jurisdiction of the French Courts which are obliged to apply French law.

ARTICLE 12: PRIVACY OF PERSONAL INFORMATION

Personal information requested of a Buyer when placing an order is essential. This information may also be used to improve service quality and Buyer satisfaction by providing them with information regarding special offers and services or other information that may interest the Buyer. Buyers who do not wish to receive such information can tick the box provided for this purpose on the information form or by sending an email to: webshop@sbe-online.com.
